The criminal justice system is known for punishing the offenders, but is not built to address the harms sustained by survivors. A victim does not have the ultimate say in the outcome of the criminal case, and at the conclusion can be left feeling ignored and overlooked. Many believe that criminal court is the only avenue of achieving accountability and justice. However, the civil justice system is built to provide accountability and compensation for the harm/damage survivors have sustained. It is a process that allows the survivor to make the ultimate decision as to whether to bring a civil case (sue) and whether to accept a settlement or go to trial.
Bringing a civil case is not the right decision for everyone and depends on many varying factors. But it is an option that more survivors and victims should be aware of and explore. Navigating the intricacies and nuances between the criminal and civil world is confusing and you shouldn’t have to do it alone. In her practice, Ashley represents crime victims and survivors to ensure their constitutional and statutory rights are upheld in in the criminal process, she can assist in obtaining order of protections and pursue civil lawsuits against assailants and liable third parties on behalf of her clients.
